第二百七十五条 新设、改设、扩大入河排污口，应当按照规定报经有管辖权的生态环境主管部门或者国务院生态环境主管部门流域生态环境监督管理机构同意。新设、改设、扩大可能影响防洪、供水、堤防安全、河势稳定的入河排污口的，审批时应当征求地方人民政府水行政主管部门或者有关流域管理机构的意见。入河排污口设置和管理的具体办法由国务院生态环境主管部门制定。
